These Terms of Service (the "Terms") govern your access to and use of the Gamecob website and related services that link to these Terms (collectively, the "Service"). The Service is operated by LTVISION CORP ("Gamecob," "we," "us," or "our"), located at 4034 Willow Grove Rd, Camden, DE 19934, United States.
By accessing or using the Service, creating an account, playing a game, or purchasing any paid features, you agree to these Terms. If you do not agree, do not use the Service.
These Terms also incorporate our Privacy Policy, Billing Terms, and Money-Back Policy (together, the "Policies"). If a Policy conflicts with these Terms on a specific topic (for example, billing or refunds), the relevant Policy controls for that topic.
1) The Service
Gamecob is a subscription-based web game hub that offers instant-play, browser-based games across genres such as puzzle, arcade, cozy, and brain games. There are no downloads and no app store: games run directly in your browser, and the same games run across your devices with progress sync. Once a game has loaded for the first time, it keeps working offline. Every game feeds global and weekly leaderboards, and weekly leaderboards reset each week. New games are added weekly.
The games, leaderboards, scores, rankings, and related material made available through the Service are collectively referred to as "Content."
Entertainment only. The Service is provided for entertainment purposes only. Leaderboard standings and scores are provided for entertainment and may be adjusted, reset, or removed at our discretion.
2) Eligibility and Age
The Service is intended for users 16 years of age or older. If you are under 16, you may not use the Service.
If you are 16 or older but under the age of majority in your jurisdiction, you may use the Service only with the involvement of your parent or legal guardian. By using the Service, you represent and warrant that your parent or legal guardian has reviewed and approved your use of the Service, and that any required consent is presumed and has been obtained. You further acknowledge that your parent or legal guardian is responsible for your use of the Service and for all actions and transactions made through your account to the maximum extent permitted by law.
Gamecob does not independently verify age or obtain separate parental consent and is entitled to rely on the representations in this Section.
3) Accounts and Security
Some features require an account. You agree to provide accurate, current information and to keep your login credentials secure.
You are responsible for all activity under your account, including any purchases, unless prohibited by applicable law. If you believe your account has been compromised, contact us promptly at support@gamecob.com.
4) Paid Features, Subscriptions, and Auto-Renewal
Certain features may require payment ("Paid Features"). Paid Features may include auto-renewing subscriptions and/or one-time purchases (if offered).
Checkout disclosures. Pricing, billing cadence, included features, and material terms (including any trial or promotional terms) will be displayed at checkout or within the Service and are incorporated into these Terms.
Subscription plans and introductory offers. Subscriptions are offered on a weekly or monthly basis. The monthly plan may begin with a short introductory period at a reduced price. After any introductory or promotional offer, your subscription automatically renews at the standard price displayed at checkout until you cancel. You may cancel anytime, and access continues to the end of the paid period.
Auto-renewal authorization. If you purchase a subscription, you authorize Gamecob and its payment processors to charge your payment method at the disclosed price and frequency until you cancel.
Introductory and promotional offers. Gamecob may offer introductory or other promotional pricing (a "Promotional Offer"). After a Promotional Offer (if any), your subscription continues at the standard recurring price disclosed at checkout and renews automatically until you cancel in accordance with the Billing Terms.
Cancellation. You may cancel a subscription through your account settings (if available) or by contacting support@gamecob.com. Cancellation stops future renewals. Unless stated otherwise, you will retain access until the end of the then-current billing period. Deleting your account (if available), clearing browser data, removing your payment method, or stopping use does not cancel your subscription.
Taxes. Taxes may be added where required by law.
Payment processing. Payments are processed by third-party payment processors. We do not store full payment card numbers.
Changes to pricing or features. We may change pricing or features. If changes affect your subscription, we will provide notice as required by applicable law. Changes typically apply at the next renewal unless you cancel.
5) Refunds and Billing Disputes
Refund eligibility, timelines, and procedures are governed by the Money-Back Policy and Billing Terms. No prorated refunds are provided for partial billing periods, except where required by applicable law or in the case of a billing error as described in the Money-Back Policy.
If you believe you were charged in error, contact support@gamecob.com with the details. To the extent permitted by law, you agree to give us a reasonable opportunity to investigate and resolve billing issues before initiating a chargeback.
6) Acceptable Use
You agree not to (and not to assist others to):
- use the Service for unlawful, harmful, deceptive, or fraudulent purposes;
- interfere with or disrupt the Service, systems, or networks;
- attempt to gain unauthorized access to accounts, data, or systems;
- reverse engineer, decompile, or attempt to extract source code except where such restrictions are prohibited by law;
- use bots, scrapers, or automated methods to access the Service without our written permission;
- upload or transmit malware or code intended to harm or compromise systems or data;
- infringe intellectual property or other rights of others.
Fair play. You agree not to cheat, exploit bugs, use bots or automation, or otherwise manipulate scores or leaderboard rankings. We may reset scores, remove rankings, or suspend or terminate accounts for leaderboard abuse or cheating.
We may suspend or terminate access for violations, suspected abuse, or security/compliance reasons.
7) Intellectual Property
The Service (including software, Content, games, design, and trademarks) is owned by or licensed to Gamecob and is protected by applicable intellectual property laws.
Subject to these Terms, Gamecob grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not copy, distribute, publicly display, sell, rent, sublicense, or otherwise exploit any part of the Service unless expressly permitted.
8) User Inputs, Feedback, and Outputs
User Inputs. The Service may allow you to submit information such as gameplay data, preferences, or other data ("User Inputs"). As between you and Gamecob, you retain your rights in your User Inputs.
License to operate the Service. You grant Gamecob a worldwide, non-exclusive, royalty-free license to host, store, process, use, reproduce, and display your User Inputs solely to:
- provide, maintain, and improve the Service;
- record gameplay, calculate scores, and maintain leaderboards and rankings;
- sync your progress across devices and personalize your experience;
- secure the Service, prevent fraud/abuse, enforce these Terms, and comply with legal obligations.
Feedback. If you provide suggestions or feedback, you grant Gamecob the right to use it without restriction and without compensation.
Outputs. The Service may generate scores, rankings, leaderboard standings, or summaries ("Outputs"). Outputs are provided "as is," may be inaccurate or incomplete, and may be adjusted, reset, or removed at our discretion. You are responsible for how you interpret and use Outputs.
9) Third-Party Services
The Service may integrate with or link to third-party services (e.g., payment processors, analytics, etc.) ("Third-Party Services"). Third-Party Services are not controlled by Gamecob and may be subject to their own terms and privacy practices. Your use of Third-Party Services is at your own risk.
10) Suspension, Termination, and Discontinuation
You may stop using the Service at any time. If you have a subscription, you must cancel it to stop future charges.
We may suspend or terminate your access if we reasonably believe:
- you violated these Terms or Policies;
- your use creates risk or harm to the Service, other users, or third parties;
- we must do so for legal, compliance, or security reasons; or
- we discontinue the Service (in whole or in part).
Upon termination, your license ends and you must stop using the Service. Sections that by their nature should survive will survive, including Sections 4-5 and 7-17.
11) Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, CONTENT, AND OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUTS, SCORES, OR LEADERBOARD STANDINGS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMECOB AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMECOB'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO GAMECOB FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Nothing in these Terms limits liability where such limitation is prohibited by law.
13) Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Gamecob and its affiliates and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another.
14) Governing Law; Venue
These Terms and any dispute arising out of or relating to the Service are governed by the laws of the State of Delaware, without regard to conflict of laws rules.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of such courts.
15) Changes to the Terms
We may update these Terms from time to time by posting the updated version on the Service. Except where notice is required by applicable law, we are not obligated to provide notice of updates, and it is your responsibility to review these Terms periodically. Unless otherwise stated, changes are effective when posted. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
16) Miscellaneous
Entire agreement. These Terms and the Policies constitute the entire agreement between you and Gamecob regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
No waiver. Our failure to enforce any provision is not a waiver.
Electronic communications. By using the Service, you consent to receive communications from us electronically (e.g., email, in-app notices) and agree that such communications satisfy any legal requirement that communications be in writing.
